Axis Can't Duck Xcel Coverage Suit Over Fatal Plant Fire

Law360, New York (September 4, 2012, 7:32 PM EDT) -- A Colorado federal judge on Tuesday refused to toss Xcel Energy Inc.'s suit claiming Axis Surplus Insurance Co. must pay settlement costs for a fire that killed five workers, saying the Colorado law at issue in the case was unsettled.

U.S. District Judge Richard P. Matsch said he could not yet rule on the insurer's motion to dismiss, which argued that Xcel's Public Service Co. of Colorado unit violated its contract with Axis by agreeing to the settlement without the insurer's consent.
