Skadden Atty Says ACA Exchanges Can't Handle Subsidy Math

Law360, New York (September 11, 2012, 3:06 PM EDT) -- A former Internal Revenue Service commissioner, now an attorney at Skadden Arps Slate Meagher & Flom LLP, warned Congress on Tuesday that health reform will falter unless exchanges are spared from calculating subsidies and the IRS gets more power to enforce coverage mandates.

Fred T. Goldberg, who helmed the agency from 1989 to 1992, told the oversight subcommittee of the House Ways and Means Committee that exchanges will determine subsidies based on tax returns filed two years earlier while also trying to keep up with income...
