Pittsburgh Fracking Ban At Odds With State Law, PUC Says

Law360, Philadelphia (September 11, 2012, 8:40 PM EDT) -- The Pennsylvania Public Utilities Commission on Monday told Pittsburgh that the city’s ban on fracking violates a state law aimed at promoting Marcellus Shale drilling in the state.

According to a nonbinding advisory opinion, the city’s comprehensive prohibition on commercial natural gas extraction is at odds with a section of state law preventing municipalities from enacting local laws that preempt state environmental statutes.
