Entergy Fights Vermont's $13M Tax On Nuclear Plant

Law360, New York (September 13, 2012, 9:11 PM EDT) -- Entergy Corp. filed suit Wednesday challenging a nearly $13 million annual levy Vermont has imposed on the company’s Vermont Yankee nuclear plant, signaling Entergy is determined to shake state obligations as the plant enters a new 20-year operating period.

Entergy is asking a federal court for an injunction barring the state from imposing the levy — which would raise the company’s annual fees paid to the state from $5 million to $12.8 million — arguing it’s excessive, unconstitutional and preempted by federal law.
