State Immune To Medicaid Rate Claims, Mass. High Court Says

Law360, New York (September 14, 2012, 4:47 PM EDT) -- The Massachusetts Supreme Judicial Court on Friday upheld the dismissal of several hospitals' claims alleging the state failed to fairly reimburse them for their treatment of Medicaid beneficiaries, ruling the claims were barred by law.

The high court ruled that Superior Court Judge Judith Fabricant had correctly found that even if the plaintiffs’ allegations that they had been paid less than the costs of care for Medicaid patients by the state Office of Health and Human Services were legitimate, the state was immune from the claims....
