Fortescue Gets Redo In Bid For Rio Tinto, BHP Rail Access

Law360, New York (September 17, 2012, 9:28 PM EDT) -- Struggling iron ore miner Fortescue Metals Group Ltd. got a boost Friday when Australia's highest court ordered the national competition board to reconsider the miner's application for access to two rivals' transport networks, saying the board's 2010 denial was illegal.

“The High Court today held that the Australian Competition Tribunal's review of the … decision whether to declare certain services relating to railway lines in the Pilbara … had not been undertaken according to law,” the High Court of Australia stated Friday.
