Whirlpool Fights Arbitrator On Smokers Premium

Law360, New York (October 19, 2007, 12:00 AM EDT) -- Home-appliance giant Whirlpool Corp. asked a federal court on Thursday to overrule an arbitrator who ordered the company to return a health insurance surcharge paid by workers who smoked.

The petition to vacate the award was filed in U.S. District Court for the Southern District of Indiana.

Whirlpool argued the arbitrator acted outside his authority when he modified the terms of a valid collective bargaining agreement between the company and the International Union of Electronic, Electrical, Salaried, Machine & Furniture Workers.
