Senate Bill Would Let States Take Lead On Local Fracking Issues

Law360, New York (September 19, 2012, 3:22 PM EDT) -- A Republican senator floated legislation Wednesday that would give state governments control over how to regulate hydraulic fracturing within their borders by creating new checks against federal regulators like the U.S. Environmental Protection Agency.

Introduced by Sen. John Hoeven, R-N.D., the Empower States Act would bar the EPA and other federal agencies from issuing “any new regulations” involving fracking for oil and natural gas without first consulting with state, tribal and local officials.
