EPA Overstepped Law By Voiding CWA Permits, DC Circ. Told

Law360, New York (September 20, 2012, 5:47 PM EDT) -- Ten business associations told the D.C. Circuit on Wednesday that the U.S. Environmental Protection Agency had overreached its authority by revoking several coal-mine water discharge permits issued by the U.S. Army Corps of Engineers, introducing uncertainty to thousands of pending projects.

According to the associations' amicus brief, the EPA had revoked the Mingo Logan Coal Co. fill material discharge permits — issued by the Corps under Section 404(a) of the Clean Water Act — by withdrawing the underlying specified disposal site. This was the first time...
