Arch Coal Unit Reaches Tentative Deal To End CWA Suit

Law360, New York (September 21, 2012, 2:27 PM EDT) -- An Arch Coal Inc. unit reached a tentative agreement to pay $575,000 to settle allegations over Clean Water Act violations stemming from pollution discharge into rivers and streams from its eastern Kentucky mines, the Kentucky Department for Environmental Protection confirmed Friday.

International Coal Group agreed to pay the settlement, which would go toward water cleanliness efforts in the state and includes $240,000 for water quality monitoring efforts, and $335,000 to remove straight pipes of residential waste to natural waters, according to the proposed agreement in principle...
