Fed. Circ. Finds Travel Caddy Didn't Mislead USPTO

Law360, New York (September 24, 2012, 7:11 PM EDT) -- The Federal Circuit said Friday that Travel Caddy Inc. had not purposely deceived the U.S. Patent and Trademark Office and could enforce its tool bag patents, but ruled anyway that a competitor did not infringe the disputed designs.

In a split decision, a three-judge panel reversed a lower court's ruling that Travel Caddy couldn't enforce two patents because of inequitable conduct, saying the company did not intend to mislead the USPTO by allegedly withholding information about the underlying patent infringement suit.
