Pa. Enviros Challenge Emissions Ruling On Sunoco Refinery

Law360, Philadelphia (September 25, 2012, 7:34 PM EDT) -- The Pennsylvania Department of Environmental Protection erred when it  treated two Philadelphia-area refineries owned by Sunoco Inc. as a single entity, a Pennsylvania environmental group argued Monday, saying the move was a departure from long-standing practice.

In a filing with the state’s Environmental Hearing Board, the Clean Air Council contended that the determination will unfairly allow Sunoco to obtain emissions offsets for its Philadelphia refinery as a result of the recent shutdown of its refinery in nearby Marcus Hook, Pa.
