Vodka Maker Can't Stop Jim Beam From Using Lip Marks

Law360, New York (September 26, 2012, 2:52 PM EDT) -- A Nevada federal judge ruled Tuesday that the maker of Johnny Love Vodka can't force Beam Inc. to stop using lip designs on its vodka bottles, finding that no reasonable consumer would confuse the spirits-makers' distinctive uses of lips on their bottles.

JL Beverage Co. LLC alleges that the Jim Beam maker’s line of flavored Pucker Vodkas have labels with images of lips nearly identical to those in use by JL Beverage, which unfairly capitalizes on Johnny Love Vodka’s business.
