GOP Sens. Blast Obama's NLRB Appointments In DC Circ.

Law360, Los Angeles (September 26, 2012, 8:17 PM EDT) -- Senate Republicans on Wednesday filed an amicus brief in a case before the D.C. Circuit challenging the constitutionality of President Barack Obama's so-called recess appointments to the National Labor Relations Board, saying the move "eviscerated" Senate powers.

The brief argues that Obama didn't have the power to make the Jan. 4 recess appointments to the NLRB because the Senate was in session at the time they were made. The filing was signed by 42 of 47 Senate Republicans.
