Duquesne Says Church Affiliation Bars NLRB Jurisdiction

Law360, New York (September 27, 2012, 3:46 PM EDT) -- The National Labor Relations Board should vacate an election in which adjunct faculty members at Duquesne University voted for union representation because the Catholic school's religious nature makes it exempt from NLRB jurisdiction, the university said Tuesday.

Pittsburgh-based Duquesne University of the Holy Spirit filed a motion asking the NLRB to order an evidentiary hearing on the jurisdiction issue, vacate a mail ballot election held this summer and dismiss the United Steelworkers' petition to represent non-tenure-track adjunct faculty members at Duquesne's McAnulty College and Graduate School...
