Greenberg Can't Shake Nev. Cab Co.'s Malpractice Claim

Law360, New York (September 27, 2012, 5:13 PM EDT) -- A Nevada federal judge on Thursday rejected a bid by Greenberg Traurig LLP to dismiss a taxi company's malpractice suit relating to a failed acquisition, ruling that the Nevada Supreme Court must decide whether there is a malpractice exemption to the state's litigation privilege.

U.S. District Judge Gloria M. Navarro ruled that no precedent exists for whether Nevada law allows plaintiffs to sue a law firm for statements made during litigation — which normally are protected by privilege — if it is a legal malpractice suit....
