Lipitor Patent Upheld By Spanish Appellate Court

Law360 (October 23, 2007, 12:00 AM EDT) -- A Spanish appellate court has overturned a lower court’s ruling and upheld Pfizer Inc.’s patent for its blockbuster cholesterol drug Lipitor, the pharmaceutical company said Tuesday.

The Court of Appeal of Barcelona ruled that Pfizer’s enantiomer patent, which covers the calcium salt found in Lipitor’s active ingredient atorvastatin, is valid and would be violated by generic versions manufactured by Lek Pharmaceuticals DD. The appellate court’s ruling overturned an earlier decision in favor of Lek, which Pfizer appealed.
