ITC Judge Finds No Breach Of Kaneka's Supplement Patent

Law360, New York (September 28, 2012, 3:51 PM EDT) -- The U.S. International Trade Commission on Thursday ruled that China's Shenzhou Biology & Technology Co. Ltd., New York-based Maypro Industries Inc. and others that import health supplement and cosmetic products did not infringe a patent covering Kaneka Corp.'s coenzyme Q10 dietary supplement.

Administrative Law Judge Robert K. Rogers handed down the initial determination, also finding that no domestic industry exists that exploits Kaneka’s patent, which covers a method for manufacturing coenzyme Q10 on an industrial scale.
