Cozen, Ex-Wolf Block Partners Spar Over Unserved Suit

Law360, Philadelphia (October 2, 2012, 12:20 PM EDT) -- An attorney for Cozen O'Connor sought to persuade the Pennsylvania Superior Court on Tuesday that a trial court should not have granted a voluntary discontinuance to four former partners of dissolved law firm Wolf Block LLP who sued Cozen in 2011.

Robert Fiebach contended the former partners started the suit, but deliberately failed to serve a writ of summons. He argued that under Pennsylvania law, the trial court was obligated to conduct a hearing over the intentional refusal to serve the writ before allowing the discontinuance....
