Judge Invalidates 2 More Kimberly-Clark Diaper Patents

Law360, New York (October 1, 2012, 4:38 PM EDT) -- A Wisconsin federal judge on Friday declared two of Kimberly-Clark Worldwide Inc.'s diaper patents invalid, paring down the company's long-running infringement lawsuit against rival First Quality Baby Products LLC.

U.S. District Judge William C. Griesbach ruled that U.S. Patent Number 6,849,067 — a design for training pants with with a refastenable side opening — was rendered obvious by earlier designs, and that U.S. Patent Numbers 6,307,119, which covered pants with a wetness indicator, was anticipated by prior art.
