11th Circ. Says Nurses At Fla. Clinic Are Supervisors

Law360, New York (October 2, 2012, 6:50 PM EDT) -- The Eleventh Circuit on Tuesday overturned a National Labor Relations Board decision that a Florida health care center violated labor laws when it refused to bargain with a group of its nurses, saying the nurses shouldn't have been allowed to unionize because they hold supervisory positions.

A three-judge panel said in a split decision that the NLRB neglected key evidence concerning the supervisory role of Wedgewood Healthcare Center's licensed practical nurses when it permitted them to hold a union election.  Wedgewood's appeal challenged the board's determination...
