Insurer Seeks To Duck Coverage In Smartphone Case IP Row

Law360, New York (October 4, 2012, 12:55 PM EDT) -- Southern-Owners Insurance Co. on Tuesday asked a Colorado federal court to declare that it has no duty to defend or indemnify Aqua Box Products Inc. in an underlying patent suit over waterproof cases for electronic devices such as smartphones.

Southern-Owners is asking the court to declare that the general liability insurance policy it issued to Aqua Box does not cover allegations in the underlying suit that Aqua Box infringed two patents held by Otter Products LLC, the maker of the OtterBox protective cases for smartphones....
