5th Circ. Won't Review Scruggs Son's Misprision Conviction

Law360, New York (October 4, 2012, 10:16 PM EDT) -- The Fifth Circuit declined Monday to rehear an appeal by the son of an ex-attorney convicted in judicial bribery scandals, after the appeals court previously upheld a Mississippi federal court's refusal to ax the son's misprision of a felony conviction.

In a per curiam decision, a three-judge panel shot down David Zachary Scruggs' petition for a rehearing of the action or to have the entire appeals court reconsider the case, noting that no active Fifth Circuit judge has asked for the whole court to be polled...
