8th Circ. Junks Mo. Official's ACA Individual Mandate Suit

Law360, New York (October 4, 2012, 6:26 PM EDT) -- The Eighth Circuit nixed a challenge Thursday to the Affordable Care Act's individual mandate brought by Missouri's lieutenant governor and a state resident, saying both lack standing because they haven't suggested they intend to make insurance coverage decisions that wouldn't comply with the law.

Nowhere in the lawsuit does Lt. Gov. Peter Kinder say he'll go without health insurance or otherwise fall short of the law's minimum coverage requirement, meaning he isn't poised to suffer any harm as a result of the mandate, which the U.S....
