Denied Injunction, FTC Continues Whole Foods Battle

Law360 (October 25, 2007, 12:00 AM EDT) -- The U.S. Federal Trade Commission has refused to back down from its fight against the $565 million merger of the two largest natural food stores in the United States, Whole Foods Market Inc. and Wild Oats Markets Inc.

In court documents filed Monday in the U.S. Court of Appeals for the District of Columbia Circuit, the FTC objected to Whole Foods' motion to dismiss the case as moot. The regulator said the grocer was trying to avoid a review of a district court decision.
