Air Equipment Co. Sues Insurer Over Asbestos Defense Switch

Law360, New York (October 5, 2012, 6:52 PM EDT) -- An air and gas equipment maker launched a lawsuit Thursday in Pennsylvania federal court claiming Utica Mutual Insurance Co. had breached a settlement agreement with the company by handing off the defense of underlying asbestos claims to National Indemnity Co.

Howden North America Inc., the equipment maker, had reached a 2005 coverage-in-place settlement agreement with Utica and four other insurers that had provided historical general liability coverage to the company and its predecessors at various points between 1961 and 2002, according to its complaint.
