1st Circ. Revives Fired Ex-Lax Plant Worker's Age Bias Suit

Law360, New York (October 10, 2012, 7:21 PM EDT) -- The First Circuit on Wednesday resuscitated an age discrimination lawsuit brought by a former manager at a Puerto Rican Novartis Ex-Lax Inc. manufacturing plant, saying a jury should decide whether the man was fired because of performance problems as the company claims or because of his age.

A three-judge panel said Hernan Acevado-Parrilla had offered sufficient evidence to raise a factual question as to whether his supervisor used a series of incidents at the Ex-Lax facility as context to fire him.
