Pa. High Court To Hear Asbestos Expert Evidence Challenge

Law360, Philadelphia (October 12, 2012, 2:43 PM EDT) -- The Pennsylvania Supreme Court said Thursday it would hear an appeal of a lower court's ruling allowing plaintiffs in asbestos cases to rely on expert affidavits to survive summary judgment bids instead of having to submit direct evidence of exposure to specific asbestos-containing products.

The high court agreed to consider an appeal by five companies — including Ace Hardware Corp. and Union Carbide Corp. — of a 2011 Superior Court decision that vacated a trial court’s dismissal of asbestos mass tort claims against the companies....
