Ear Candler Loses Cert. Bid In Suit Over FDA Warning Letters

Law360, New York (October 15, 2012, 7:44 PM EDT) -- The U.S. Supreme Court declined Monday to take up a holistic health group's challenge to a D.C. Circuit ruling that U.S. Food and Drug Administration warning letters are not subject to review in court because they are not final agency actions.

The high court denied a petition for certiorari from the Holistic Candlers and Consumer Association and others that argued the D.C. Circuit incorrectly ruled in January that FDA warning letters issued to ear candle makers were not subject to judicial review under the Administrative Procedures...
