Generac Miscast Ad Claim Decision To Customers, NAD Says

Law360, Chicago (October 15, 2012, 4:00 PM EDT) -- The National Advertising Division took Generac Power Systems Inc. to task on Thursday for mischaracterizing an NAD recommendation that it ax certain ad claims for its generators, echoing the disapproval it recently rained down on ad challenger Kohler Co.

The NAD, the investigative unit of the advertising industry's self-regulatory system, said that participation agreements signed by all parties that take part in the system make clear that they are barred from using NAD decisions for promotional purposes or mischaracterizing them.
