Scottsdale Should Cover Faulty Pool Woes, 2nd Circ. Hears

Law360, New York (October 19, 2012, 5:30 PM EDT) -- The Second Circuit should overturn a court ruling that Scottsdale Insurance Co. does not have to cover problems with pools installed by R.I. Pools Inc., the Connecticut company said Friday, arguing that Connecticut courts should weigh in on the law.

The Connecticut Supreme Court has yet to rule on whether the term “accident” in insurance policies covers accidents due to faulty workmanship, R.I. Pools attorney Charles W. Fleischmann of Bai Pollock Blueweiss & Mulcahey PC argued before a three-judge appeals panel.
