Ind. Can't Defund Planned Parenthood, 7th Circ. Says

Law360, New York (October 23, 2012, 5:34 PM EDT) -- The Seventh Circuit ruled Tuesday that Indiana couldn't block Medicaid funds from organizations that perform abortions, handing a victory to Planned Parenthood of Indiana in finding that a new state law likely violates a federal statute allowing Medicaid patients free choice of providers.

The ruling leaves in place a lower court's preliminary injunction allowing Medicaid funds to continue flowing to Planned Parenthood clinics. The court found that the law, signed in May 2011 by Republican Gov. Mitch Daniels, likely violated federal Medicaid law by restricting beneficiaries'...
