Icon's Elliptical Patent Suit Junked By Fed. Circ.

Law360, New York (October 24, 2012, 8:16 PM EDT) -- The Federal Circuit on Wednesday affirmed a lower court's decision that a line of elliptical machines from Octane Fitness had not infringed a patent held by exercise equipment giant Icon Health & Fitness Inc.

A three-judge panel said U.S. District Judge Ann D. Montgomery had correctly ruled that Octane's Q45 and Q47 model ellipticals lacked key elements of Icon's U.S. Patent Number 6,019,710, making literal infringement impossible.
