Judge Tosses Welding Fume Suits Against Caterpillar

Law360, New York (October 31, 2007, 12:00 AM EDT) -- A judge has thrown out all cases against heavy-equipment manufacturer Caterpillar Inc. in the multidistrict welding fume litigation, saying there is insufficient evidence to conclude it conspired with the other defendants to hurt the plaintiffs.

In a decision filed Tuesday, Judge Kathleen McDonald O'Malley of the U.S. District Court for the Northern District of Ohio dismissed all of the cases against the company.
