GSK Targeted In Antitrust Suit Over Drug-Discount Program

Law360, New York (October 26, 2012, 4:42 PM EDT) -- A Nevada clinic hit GlaxoSmithKline LLC, nonprofit Apexus Inc. and a public health agency with an antitrust complaint Thursday alleging abuse of a federal drug-discount program, echoing concerns from Congress this year that participants are reaping improper benefits.

The Vaccine Center and Travel Medicine Clinic in Las Vegas says the Southern Nevada Health District uses its status as a nonprofit to obtain reduced-cost drugs under the so-called 340B program and then operates as a “full-fledged commercial business” by reselling the medicines to the general population instead...
