Court Says ITC Erred In LED Claim Construction

Law360 (October 31, 2007, 12:00 AM EDT) -- A federal appeals court panel ruled Wednesday that the International Trade Commission erred in its claim construction of Osram GmbH's patents covering light-emitting diode products and that the patents were therefore infringed by Dominant Semiconductors.

In its opinion, the U.S. Court of Appeals for the Federal Circuit said the ITC should have calculated the mean diameter of phosphor grains contained in the LEDs based on the total number of grains and not on volume.
