Evanston Seeks To Escape Coverage Of Fungal Dye Suits

Law360, New York (October 26, 2012, 5:48 PM EDT) -- Evanston Insurance Co. asked a Florida federal judge on Friday to declare that it has no obligation to defend Franck's Lab Inc. against allegations of selling contaminated dye that caused eye surgery patients to suffer fungal infections, pointing to a mold exclusion in its general liability policy.

Franck's, a Florida-based compounding laboratory, issued a recall in March of its Brilliant Blue G dye after patients treated with the product came down with the eye infections. The company is now facing two lawsuits seeking damages for negligence...
