CPSC Spanking Brings Hope For Consumer Products Industry

Law360, New York (October 30, 2012, 2:09 PM EDT) -- In an important victory for the consumer products industry struggling in the face of regulatory overreach by an increasingly aggressive Consumer Products Safety Commission, a company — proceeding under the pseudonym Company Doe — prevailed this month in an action against the CPSC in federal district court in Maryland. The lawsuit arose out of the CPSC’s decision to publish a “report of harm,” ostensibly related to one of Company Doe’s products, on its new product safety database, saferproducts.gov.
