Tobacco Cos. Fight DC Circ. Rehearing Of Warning Label Suit

Law360, New York (October 30, 2012, 3:59 PM EDT) -- R.J. Reynolds Tobacco Co. and other tobacco giants urged the D.C. Circuit on Monday not to reconsider its recent finding that the U.S. Food and Drug Administration's mandatory graphic warnings for cigarette packages are unconstitutional, saying the agency is not even looking to defend all of the warnings.

A majority of a three-judge panel ruled in August that the FDA did not present “a shred of evidence” that demonstrated the warnings — which include images of diseased lungs and a man smoking from a tracheotomy hole...
