AstraZeneca's Suit Vs. Novartis To be Heard in NZ High Court in February

Law360, New York (November 20, 2003, 12:00 AM EST) -- AstraZeneca's lawsuit against Novartis over Novartis' plans to sell a drug to treat gastric ulcers in New Zealand

will be heard at the Auckland High Court in February, the Independent Business Weekly reported.

AstraZeneca claims that Novartis' drug would infringe its patent on its blockbuster drug Losec.

Novartis denies its Probitor drug infringes AstraZeneca's patent and alleges the patent is invalid anyway due to "lack of novelty" and "obviousness."
