Texas Court Flips Law Firm Award Over Bad Discovery Review

Law360, Dallas (November 1, 2012, 3:51 PM EDT) -- A Texas appellate court on Thursday said a boutique litigation firm in Dallas hadn’t proven that the time its attorneys spent dealing with botched discovery review by an outside company translated into lost profits, reversing a breach of contract award the firm won at trial.

The appellate panel held that the firm, David W. Elrod PLLC, failed to show any evidence it missed out on profits as a result of a contract breach by the legal services company A-Legal Copy & Record Services. The firm said...
