Insurer Off Hook For Wal-Mart Antitrust Suit Defense

Law360, New York (November 5, 2012, 3:42 PM EST) -- The First Circuit on Friday upheld a ruling that Endurance American Specialty Insurance Co. had no duty to cover The Saint Consulting Group Inc. in antitrust litigation over the company's alleged role in blocking two proposed Wal-Mart stores in Illinois.

Because the allegations against Saint Consulting were that it and retailer SuperValu Inc. engaged in a campaign designed to frustrate competition from Wal-Mart, a three-judge panel said Endurance was correct in denying coverage based on an exception that barred coverage for antitrust claims.
