Enterprise Targets Ind. County Over Pipeline Zoning Rule

Law360, New York (November 6, 2012, 4:43 PM EST) -- An Enterprise Product Partners LP unit sued an Indiana county in federal court Monday, seeking to block a zoning ordinance the company says threatens its ATEX Express natural gas pipeline project and is preempted by state and federal law.

According to Enterprise Liquids Pipeline LLC’s complaint, the county of Decatur’s zoning ordinance, amended in September to cover several additional categories of pipeline and associated infrastructure, including the 1,230-mile ATEX Express underground pipeline, was an attempt to “confer upon itself the authority to regulate interstate pipelines.” The...
