Enviro Settlement Doesn't Nix Sewage Dumping Suit, Judge Says

Law360, New York (November 7, 2012, 1:34 PM EST) -- A Mississippi federal judge refused Tuesday to dismiss an environmental group's Clean Water Act suit accusing Hattiesburg, Miss., of unlawful sewage and wastewater discharges, ruling the group can pursue its claims despite the city's recent settlement with the state's environmental regulator.

Hattiesburg entered into the agreement in February with the Mississippi Department of Environmental Quality addressing the discharges, consenting to monetary penalties for failing to meet deadlines for upgrading its wastewater treatment facilities.
