Texas High Court Floats Rules For 'Loser-Pays' Dismissals

Law360, Dallas (November 13, 2012, 10:56 PM EST) -- The Texas Supreme Court on Tuesday proposed new rules that implement the “loser-pays” set of tort reform measures passed by the state legislature in 2011, allowing defendants to more quickly escape meritless lawsuits and requiring expedited timelines for cases worth less than $100,000.

In the proposed new Rule 91a of the Texas Rules of Civil Procedure, Texas will for the first time allow defendants to move to dismiss “baseless causes of action” on the grounds that the civil suit is unsupported by law or facts. Parties...
