Fed. Circ. Sets Clock On Patent Inventorship Suits

Law360, New York (November 14, 2012, 4:38 PM EST) -- The time period in which a suit seeking to correct the named inventors on a patent must be filed begins when the patent is issued, the Federal Circuit ruled Wednesday, reversing the dismissal of a suit over superconductive compounds as time-barred.

A lower court ruled that two people who claimed they were erroneously omitted as inventors on two patents waited too long to sue because they should have known when the applications were filed that they were not listed as inventors.
