6th Circ. Narrowly Shoots Down Mich. Affirmative Action Ban

Law360, New York (November 15, 2012, 7:04 PM EST) -- A divided Sixth Circuit on Thursday struck down part of a Michigan constitutional amendment that banned affirmative action in state college admissions and government hiring, finding the ban violated the 14th Amendment's equal protection clause.

In an 8-7 decision, a majority of Sixth Circuit judges conducting an en banc review determined that the Michigan law ran afoul of the U.S. Constitution.
