Oregon Enviro Agencies Hit With Suit Over CWA Permits

Law360, New York (November 20, 2012, 8:37 PM EST) -- A livestock auctioneer sued Oregon's departments of Environmental Quality and Agriculture in federal court Friday, alleging they have administered a pollution control permit program under federal Clean Water Act regulations for decades while lacking proper authority.

B & K Livestock Auction Inc., which runs auctions of cattle and other livestock in Junction City, Ore., claims that the two state agencies never officially received approval from the U.S. Environmental Protection Agency to administer the National Pollutant Discharge Elimination System permit process under the Clean Water Act.
