Insurers Say Exclusions Bar Coverage In TCPA Class Action

Law360, New York (November 20, 2012, 2:29 PM EST) -- National Fire Insurance Co. of Hartford and Continental Casualty Co. on Monday asked a federal judge to find they have no duty to cover plaque maker That’s Great News LLC in a proposed class action over its alleged violation of the Telephone Consumer Protection Act.

The insurers claim in a motion that they are entitled to summary judgment under the policies they issued to the company because “distribution of material in violation of statutes,” “distribution of material in violation of law” or “do not call” exclusions...
