Judge Blocks Patent Claims During Elpida Bankruptcy

Law360, Wilmington (November 20, 2012, 8:45 PM EST) -- A Delaware bankruptcy judge on Tuesday refused to allow a patent licensing firm and two universities to pursue patent infringement claims against Elpida Memory Inc. while it is under court protection, finding that the automatic stay in the bankruptcy shields the Japanese chipmaker.

U.S. Bankruptcy Judge Christopher S. Sontchi ruled at a court hearing in Wilmington that Elpida's automatic stay still applies to Canada-based licensing firm Mosaid Technologies Inc.'s lawsuit because the company could have brought its infringement claims before the bankruptcy filing, rejecting its claim...
